The public KS-CPOST Commission meeting was called to order by Chair Brandon J. Johnson with a roll call of commissioners in attendance as listed above.  KS-CPOST and KLETC staff also in attendance as listed above.

 

Approval of minutes

A motion (2020 M 03) was made by Commissioner Herzet and seconded by Commissioner Wood to approve the minutes of the October 23, 2019 commission meeting.  Motion passed unanimously

 

Commissioner Bauer made a motion (2020 M 04) to approve the minutes of the December 23, 2019 commission meeting.  The motion was seconded by Commissioner Bundy and passed unanimously. 

 

Motion (2020 M 05) was made by Commissioner Herzet and seconded by Commissioner Bundy to approve the minutes of the March 13, 2020 commission meeting.  Motion passed unanimously.

 

KSCPOST Director’s Report

Executive Director Gary Steed presented his report which included KS-CPOST’s budget, Central Registry statistics, investigation statistics, the Commission on Racial Equity and Justice’s request for statistics from KS-CPOST, and updates on the IAPro software to better track the investigators’ cases.  He also briefed the commission on how Covid-19 has affected the KS-CPOST office and the steps taken to continue to effectively serve the law enforcement agencies and the public.   

 

KLETC Director’s Report

Executive Director Darin Beck of the Kansas Law Enforcement Training Center presented his report on KLETC’s campus master plan for renovations, the training center’s strategic plan for the upcoming years, the effects Covid-19 has had on KLETC personnel and the academies, the record number of officers trained in basic training and in continuing education, and KLETC’s partnerships with the Sheriff’s Association educating jailers and other public safety personnel.  Director Beck spoke on the history of the policing class, the racial diversity of instructors at KLETC and the team effort they have received from other law enforcement agencies in providing over 400 guest instructors.

 

KLETC Curriculum and Testing Administrator Scot Brownrigg informed the commission of the proposed updated basic training curriculum.

 

Commissioner Presley made a motion (2020 M 06) to appoint Commissioner Don Scheibler to the Hearing Panel Committee to replace Commissioner Kelly Herzet.  The motion was seconded by Commissioner Herzet and passed unanimously. 

 

A motion (2020 M 07) was made by Commissioner Scheibler and seconded by Commissioner Herzet to appoint Commissioner Gaten Wood as an alternate to the Hearing Panel Committee.  The motion passed unanimously.

 

Commissioner Scheibler moved to appoint Commissioner Mark Bundy as an alternate to the Hearing Panel Committee.  His motion (2020 M 08) was seconded by Commissioner Wood and the motion passed unanimously.

 

Commissioner Jones made a motion (2020 M 09) to appoint Commissioner Cole Presley to the Curriculum Committee to replace Commissioner Herman Jones.  The motion was seconded by Commissioner Herzet and passed unanimously.

 

A motion (2020 M 10) to appoint Commissioner Robert Angell to the Curriculum Committee to fill the vacancy was made by Commissioner Scheibler and seconded by Commissioner Bundy.  The motion passed unanimously.

 

Commissioner Bauer made a motion (2020 M 11) to appoint Kansas Highway Patrol Captain Chris Bauer to the Curriculum Committee to replace Kansas Highway Patrol Captain Robert Allan Lytton.  The motion was seconded by Commissioner Scheibler and passed unanimously.

 

Commissioner Scheibler moved to appoint Commissioner Tim Bauer to the Municipal Reimbursement Committee to replace Commissioner Thomas Hongslo effective December 18, 2020.  His motion (2020 M 12) was seconded by Commissioner Bundy and the motion passed unanimously.

 

A motion (2020 M 13) to make the appointments of Commissioner Cole Presley, Commissioner Robert Angell and Kansas Highway Patrol Captain Chris Bauer to the Curriculum Committee effective October 14, 2020 was made by Commissioner Herzet and seconded by Commissioner Angell.  The motion passed unanimously.

 

Commissioner Angell made a motion (2020 M 14) to make the appointment of Commissioner Don Scheibler to the Hearing Panel Committee replacing Commissioner Kelly Herzet effective January 1, 2021.  The motion was seconded by Commissioner Bauer and passed unanimously.

 

Commissioner Wood moved to make the appointments of Commissioner Gaten Wood and Commissioner Mark Bundy as alternates to the Hearing Panel Committee effective October 14, 2020.  His motion (2020 M 15) was seconded by Commissioner Bundy and passed unanimously.

 

A motion (2020 M 16)  was made by Commissioner Bauer and seconded by Commissioner Hongslo for the KS-CPOST Commission to authorize staff to look at amending the administrative regulation to provide for discipline of those who don’t submit demographic reports as they should.  The motion passed unanimously.

 

After a discussion on the authority to revoke provisional certifications, Commissioner Scheibler made a motion (2020 M 17) to follow the Investigative Committee’s recommendations to revoke provisional certifications.  Commissioner Hongslo seconded the motion.  The motion passed with Commissioner Jones and Commissioner Thompson casting a no vote.

 

Commissioner Bundy moved to not proceed with changing administrative regulation K.A.R. 106-2-4 and to go back to the original K.A.R. 106-2-4.  His motion (2020 M 18) was seconded by Commissioner Bauer and passed unanimously.

 

KS-CPOST’S Counsel Michelle Meier presented to the commission and requested feedback on recommendations made by the Governor’s Commission on Racial Equality and Justice.  These recommendations included requiring officers to complete KLETC training before being issued a firearm, requiring agencies to check the KS-CPOST database for disciplinary records before hiring officers, and improving transparency around police disciplinary records.  A final recommendation by the Commission on Racial Equality and Justice was that KS-CPOST should conduct a periodic officer certification process every two years to ensure anti-bias and culturally responsive policing practices are being utilized by individual officers.  It was agreed upon that the full scope of this program is unclear, but the commission believes this could be better addressed at an agency level.

 

Commissioner Scheibler brought into discussion of having a new KS-CPOST on-line complaint form for law enforcement officers to report the misconduct and violations of other law enforcement officers.  Director Steed stated KS-CPOST would be looking into this suggestion.

 

New Business

There was no new business to discuss.

 

Upon motion (2020 M 19) made by Commissioner Hongslo and seconded by Commissioner Angell, the meeting was adjourned at 3:23 pm by a unanimous approval.
